Toy Association Leadership Heads to Capitol Hill to Address Tariffs, EPR, & More

This week, The Toy Association’s Kathrin Belliveau, chief policy officer, and Maria Sierra, vice president of government affairs, will meet with influential congressional staff from the U.S. House of Representatives and the Senate to discuss major policy areas impacting the toy industry, including tariffs and extended producer responsibility (EPR) laws.

Additional 100% Tariffs on Chinese Imports Now on Hold Until Nov. 1

Treasury Secretary Scott Bessent confirmed Monday that President Donald Trump still plans to meet Chinese President Xi Jinping in South Korea later this month, signaling an effort to cool tensions after the President announced additional tariffs on China. According to Bessent, the proposed 100% tariffs on Chinese imports are now on hold until November 1, as high-level discussions resume.

Toy Association Advocates for Harmonized Regulatory Framework to Address Inconsistent State Laws

The Toy Association™ submitted comments on September 15 in response to the U.S. Department of Justice’s Request for Information (RFI) on “State Laws Having Significant Adverse Effects on the National Economy or Significant Adverse Effects on Interstate Commerce.” The Association’s submission highlights how a patchwork of state regulations, particularly around packaging, chemical reporting, and outdated product restrictions, creates unnecessary burdens for toy companies while doing little to improve consumer safety.

The California Department of Resources Recycling and Recovery (CalRecycle) formally published proposed regulations for Senate Bill 54 (SB 54), also known as the Plastic Pollution Prevention and Packaging Producer Responsibility Act, and opened a 45-day public comment period.

U.S. Court of Appeals Rules Global Reciprocal & Emergency Tariffs Issued under IEEPA are Illegal

The U.S. Court of Appeals for the Federal Circuit has affirmed a lower court ruling (the May 28, 2025 U.S. Court of International Trade ruling) that tariffs imposed under the International Economic Emergency Powers Act (IEEPA) by the Trump Administration are unlawful.

Supreme Court to Hear Trump Tariffs Case in November

The Toy Association™ issued an alert to members as soon as the news broke on September 9 that the U.S. Supreme Court granted certiorari on an expedited basis to hear two cases challenging the legality of President Trump’s unprecedented use of the International Emergency Economic Powers Act (IEEPA) to impose blanket tariffs on foreign imports.

Federal Lawsuit Challenges Oregon's EPR Law

The National Association of Wholesaler-Distributors (NAW) has filed a lawsuit in federal court challenging Oregon’s Plastic Pollution and Recycling Modernization Act, which established the state’s extended producer responsibility (EPR) program for packaging.
